Types of Agreements: Meaning, Examples, and Business Use

The existence of agreements creates a fundamental aspect which people encounter throughout their daily activities. The need for agreements exists in both business operations and everyday personal interactions. You reach an agreement with someone who then confirms their agreement to you. This is how encounters between people begin.

People make different types of agreements which contain multiple variations. Some agreements exist as informal arrangements, while others exist as written contracts, and others exist as legally binding documents. The process of learning about agreement types must be mastered at this point.

Agreements serve multiple purposes in both legal and business environments. The documents establish what parties must do, what they possess, and what they anticipate from each other. The different types of agreements need to be understood because they help people or businesses to avoid misunderstandings that happen in the future.

What is an Agreement?

An agreement is a mutual understanding between two or more parties where one party makes an offer and the other accepts it.

It does not always need to be written. Even verbal commitments can form an agreement. But in law, not every agreement is considered valid.

This is where the definition of contract in law becomes relevant. A contract is a legally enforceable agreement between two parties that meets specific conditions written in the contract. So while every contract is an agreement, not every agreement becomes a contract.

In business situations, the definition of contract in business law focuses more on enforceability of rules, laws and clear obligations between parties.

Types of Agreements

Agreements can be classified based on how they are formed and how they are treated under the law. There is not one single category; in fact, there are multiple types of agreements in law that serve different purposes. Today, businesses often use electronic signature software to create, sign, and manage agreements digitally, making the process faster and more convenient. Here are the most common types of agreements:

Valid Agreement

A valid agreement meets all legal requirements and can be enforced in court. It includes proper offer, acceptance, consideration, and intention.

In simple terms, this is the kind of agreement that actually works legally.

Let’s understand with an example, suppose a company hires an employee, and they both sign an offer letter with salary and role defined, and other conditions related to the employability, it becomes a valid agreement. If either party does not follow the terms, legal action can be taken.

This is what most business agreements aim to be.

Void Agreement

A void agreement has no legal effect from the beginning. Even if both parties agree, the law does not recognize it.

Usually, this happens when the purpose of the agreement is unlawful.

For example, the two people who make an illegal agreement through a signed document create a binding contract that has no legal validity. The contract becomes unenforceable because both parties signed it without their full consent. The parties involved have created a written agreement which exists on paper yet lacks legal standing.

Voidable Agreement

The agreement remains valid from its initiation until one party decides to terminate it.

The situation emerges when there is an absence of proper consent. The situation may develop through three methods, which include fraudulent activities, coercive tactics, and deceptive practices.

A person who signs a contract under forceful pressure has the right to terminate the agreement at any time. The agreement remains valid until that decision is made.

The situation becomes challenging at this point. Because one side still has control over whether the agreement continues or not.

Express Agreement

An express agreement is clearly stated. It can be written or spoken, but the terms are directly communicated.

There is no guessing involved. Everything is mentioned clearly.

For example, a service agreement where a freelancer and client define project scope, deadline, and payment in writing. Both sides know exactly what is expected.

This is one of the most common types of agreements in contract law, especially in professional setups.

Implied Agreement

People reach an unspoken agreement through their actions and conduct. People show their intentions through their actions because nothing is said or written in a clear manner.

For example, when you enter a cab and reach your destination, you are expected to pay the fare. The agreement exists even without your prior discussion about the price. The agreements establish themselves as standard practices in everyday situations.

Unilateral Agreement

In a unilateral agreement, only one party makes a promise. The other party accepts it through his particular actions. Both parties involved in the agreement failed to make any direct promises.

For example, the company publicly announces a reward for locating the lost item. The reward is given to anyone who finds and returns the item. The agreement becomes complete when the assigned work reaches completion. The agreement requires action to be performed instead of both parties needing to make promises.

Bilateral Agreement

The treaty requires both sides to make mutual commitments, which they must fulfill. Each party agrees to do something. The most common type of agreement in contract law today represents the most common form of contracts used in legal practice.

For example, a business contract exists when one company provides services to another company which agrees to make payment for those services. Both sides have clear obligations. The majority of formal contracts belong to this specific contract type.

Types of Agreements in Business

There are several types of agreements in business law that are commonly used:

  • A partnership agreement defines roles, responsibilities, and profit sharing between partners.
  • The service agreement establishes project requirements, including the variable like delivery dates and payment arrangements between the client and the person who is providing any service.
  • Non-disclosure agreements, generally known as NDAs, it protect the confidential information from unauthorized parties.
  • Employment agreements, it define job roles, salary, and the policies of the company. It happens between the employer and employee.
  • Businesses agreement, it is another type of agreement that happens between two businesses, as an agreement happens between a business and a vendor to establish relationships with suppliers who provide them with goods and services.

Most business situations require the creation of written agreements which need to be developed through precise drafting. The process establishes a clear understanding between parties while decreasing the possibility of errors.

Examples of Agreements

Understanding types is one thing. Seeing them in real situations makes it clearer.

Some common types of agreements examples include, a freelancer agreeing to complete a project for a fixed fee or a company hire an employee under defined terms or a tenant agreeing to pay rent to a landlord.

You will notice that even though these examples look different, they all follow the same basic structure.

Why Understanding Agreement Types Matters

The initial impression of agreements appears straightforward. The actual implementation of agreements leads to multiple legal outcomes which differ from each other.

Some agreements can be enforced through legal means, while other agreements face legal restrictions. Some agreements establish your legal rights, while other agreements create legal boundaries which exist only through specific definitions.

The importance of understanding different agreement types becomes essential because of their application in legal matters and business operations. The process enables you to select appropriate structures while it protects your needs and maintains clarity.

Conclusion

Agreements look straightforward, but they are not so simple all the time. There are different types of situations that need various types of agreements. Some are informal, in them but some are legally binding.

So getting an understanding of these differences helps businesses or any individual to make better decisions and avoid unnecessary problems.

Because in the end, it is not just about agreeing. It is about knowing what kind of agreement you are entering into.
